Is it legal for an Australian business to hire offshore staff?
Yes. Australian businesses can legally hire offshore staff. With Offshored, each team member is employed in the Philippines by Australian Pathways OPC, our Philippine employing entity, under Philippine labour law, and you pay Offshored one monthly service fee under a Memorandum of Understanding. That structure avoids the risks of engaging overseas contractors directly, which can fall under Australian workplace law.
Do I pay superannuation or payroll tax on offshore staff?
No. Offshored's team members are not your employees under Australian law, so superannuation guarantee, PAYG withholding, payroll tax and workers compensation do not apply to them. Australian Pathways OPC, which employs all Offshored team members, pays their salary, SSS, PhilHealth, Pag-IBIG contributions and Philippine income tax. You pay Offshored one all-inclusive monthly fee. Confirm your own position with your accountant.
Who is the legal employer of my offshore staff?
Australian Pathways OPC (Company Reg. 2023010082245-00), Offshored's Philippine employing entity, is the legal employer. It holds the employment contract, runs payroll, pays statutory contributions and benefits, provides HMO health insurance after probation, and carries the employment liability. Offshored is the Australian company you contract with. You direct the work day to day and your team member reports to you.
What is the time difference between Sydney and Manila?
Manila is two hours behind Sydney during Australian Eastern Standard Time and three hours behind during daylight saving (October to April). Brisbane is always two hours ahead of Manila, and Perth is on the same time. Offshored staff work your Australian hours regardless, so a 9am Sydney start is a 6am or 7am start in Manila.
How is my business data protected with offshore staff?
Offshored staff work inside your systems with the access you grant, so your data stays on your platforms and you can revoke access at any time. They follow your security, password and device policies, and confidentiality is written into their employment contract. A breach can mean dismissal and prosecution under the Philippine Data Privacy Act and the Australian Privacy Act.
What is the minimum commitment when hiring offshore staff?
There is no lock-in contract with Offshored. Recruitment is free until you choose a candidate and sign a Memorandum of Understanding, and after that you pay month to month, invoiced in advance. To end the arrangement you give 30 days' notice, and any month already paid is prorated. There is no exit fee.

How long does it take to hire offshore staff?
Typically one to two weeks with Offshored. A free 20-minute call this week scopes the role, shortlisting from our Manila candidate pool takes three to four days, then you interview the shortlisted candidates and choose. Because the office, equipment and Philippine employing entity are already in place, your team member can start as soon as the paperwork is signed.
Can offshore staff work Australian business hours?
Yes. Offshored staff work a standard Monday to Friday, eight-hour day at the times you set, matched to your Australian time zone. They work on Australian public holidays unless the day is also a Philippine holiday, and Offshored gives you two business days' notice of any Philippine holiday that affects your team member's schedule.
What qualifications do offshore staff have?
Offshored recruits university-educated Filipino professionals: bookkeepers and accountants, architects and drafters, estimators, administrators, customer support staff, developers and AI Operators. Every candidate is vetted by Offshored's recruitment team in BGC, Manila before you see them, and you conduct the final interview and make the hiring decision yourself, so the person matches your standard, not just ours.
What happens if my offshore staff member leaves?
Offshored replaces them at our cost, not yours. If a team member resigns or is not the right fit, Offshored recruits a replacement from our existing Manila candidate pool and presents candidates for your review before the handover date, so the work keeps moving. There is no re-recruitment fee, and leave cover is arranged the same way.
How is offshore staff performance managed?
You manage the work; Offshored and Australian Pathways OPC manage the employment. Every shift is logged on our timekeeping platform, attendance records are available on request, and staff must answer messages within ten minutes during work hours. Offshored asks for your feedback after the first month, then annually, and mediates or replaces staff who do not improve.
Our full commercial terms, including leave, invoicing and notice periods, are published in the Offshored Terms of Service. Monthly cost bands for every role are on the roles page.
